Appeals Court Rules on Tariffs

The U.S. Court of Appeals for the Federal Circuit delivered its verdict on Friday, ruling 7-4 that the International Emergency Economic Powers Act (IEEPA) does not authorize the President to impose sweeping tariffs. The decision reaffirms that tariff authority constitutionally belongs to Congress.

The practical impact remains uncertain. The court issued a temporary stay through mid-October, keeping current tariffs in place while the administration prepares its Supreme Court appeal. If the high court agrees to hear the case this fall, oral arguments would likely occur in early 2026, with a final decision expected by summer.  Read more from US Wine Trade Alliance.  The Trade Alliance continues to maintain advocacy efforts, highlighting how imported wine sustains American small businesses while negotiations proceed.

A message to our Customers

Over the past week the team has begun issuing the tariff invoices for shipments where the new 15% tariff is applied.   At the time of the announcement CBP provided information and advice about the ad valorem calculations but they did not announce how these would practically be applied to customs documents.

We have now seen the first tranche of customs summaries, and its a lot less complicated that the initial advice !  The team has an explainer we can walk you through on receiving your first 15% invoice. If you have any questions please reach out to your sales representative or to answers@elentenyimports.com and we will happily chat through the calculations on your invoice.

“Cheers to the hardest working team! Your efforts do not go unnoticed.
Have a wonderful Labor Day”

Cheers Elenteny Imports.
