2024 CBMA Assignments are Open

If you have not done so already, you may start requesting your 2024 CBMA assignments from suppliers. Foreign producers may begin entering 2024 CBMA assignments in the myTTB portal immediately. The submission period runs from October 1st, 2023 through December 31st, 2024. Please note foreign producers must also confirm or update ownership information before submitting 2024 CBMA assignments.

In our experience, it is best to request as much of your allocation as the winery will provide as early as possible, particularly if you are a non-exclusive importer. This ensures that you have the maximum tier-1 gallonage available to claim, and also that there will not be unused gallonage still available that you could have used in the 2024 calendar year.

Please be aware that even though the filing period runs through the end of the year, the costs associated with retroactive filings or post-summary corrections are significant enough that it only makes sense to do so in limited situations. If you have any other questions, please reach out to Tom Davis or Tim Kealey at CBMA@elentenyimports.com

California:  Labelling and Recycling

The State of California recently expanded the definition of “beverage” so that wine (including sparkling or carbonated), distilled spirits, wine/spirit coolers (ready-to-drink cocktails with any percentage of alcohol by volume), wine from which alcohol has been removed in whole or in part, and all ciders are subject to the state recycling rules beginning January 1, 2024.

If you operate in CA, you will now need to comply with :

  • new labeling requirements

  • pay new recycling fees

What Types of Alcohol Are Subject ?

As of January 1, 2024, you will be charged a “manufacturing” processing fee for almost all types of beverages (including N/A wine) sold in California. This fee will apply to all types of:

  • Wine: red, white, sparkling or carbonated

  • Wine from which alcohol has been removed in whole or in part

  • Spirits

  • Beer

  • Cider

Now what ??

Elenteny is required to begin collecting the recycling fee from our CA direct/retail customers and remitting it to the agency beginning January 1st, 2024.

Do I have to change my labels/packaging?

California Redemption Value (“CRV”) labeling on beverage packaging (for wine & spirits) is not mandatory until July 1, 2025. January 1, 2024, through June 30, 2025, is the “transition period” when the CRV labeling is “optional” for the newly covered products.  Wines and spirits that were filled/bottled and labeled before January 1, 2024 do not require the CRV labeling (they are exempt and will not need the CRV labeling ever).

Nonetheless, you should begin discussing these labeling changes with suppliers / manufacturers / producers now.
