We continue to receive updates on the CBMA changes for 2023. Please read the following carefully, we understand the changes add additional complexity to the process previously implemented by CBP.
We have put together some CBMA resources for our customers. You can find a link to the Elenteny CBMA webinar here. A link to our 2023 CBMA customer action list may be found here.
If you are acting on behalf of a foreign supplier, or they are registering themselves, CBMA gallonage must be allocated no later than Friday, December 23th, 2022 for shipments projected to make entry on or after January 1, 2023. Please note that changes to gallonage assignment throughout 2023 will only be possible in exceptional circumstances. Elenteny Imports can not guarantee that any shipments making clearance before registration & allocation is completed will be eligible for reimbursement at the end of Q1.
We have attached a basic tutorial on how to register as a foreign producer on the MyTTB portal. Please note this additional important information below:
- You must complete the FDA biennial registration with DUNS number prior to registering on behalf of your foreign producer or having them do so. This step is to ensure that all registrations are completed with consistent information. You can access Elenteny’s recent DUNS Webinar here.
- Gallonage allocations must be made to Elenteny’s TTB Basic Importer Permit: NY-I-15547.
- Foreign producers must supply their Foreign Producer ID on commercial invoices for shipments expected to clear after January 1, 2023. If it has already sailed, you may provide the ID to CBMA@ElententyImports.com and we will work with the customs broker to ensure TTB is aware of CBMA eligibility on entry.
- You are able to register as the US agent for a foreign producer, provided you are the exclusive US brand agent. If your winery has multiple importers, they will need to complete the registration and assignments themselves and provide you with the assignment confirmation. Please forward it to Elenteny no later than December 19th to ensure that we are able to provide notice on the entry.
We are here to help you navigate this process and understand the challenges of meeting such short deadlines at this time of year. Please let us know if we can assist you in any way.
